I was in a bad car accident yesterday. Luckily I wasn't injured badly, I'm just really sore and stiff today and I bumped my head. I was checked out at the scene and they said I was fine but I'm going to the doctor today just to get a thorough look-over. I was rear-ended and it spun me into a 180 and I hit the guard rail. The car is totaled. The guy who hit me did not own the vehicle and was arrested at the scene for driving on a suspended license.

What advice do you have in a situation like this? Should I contact an attorney? Would it be worth it?

If that driver doesn't have insurance or any intentions of paying for your totaled vehicle, then I'd say there's no harm in contacting a lawyer about a FREE consultation to see if there's anything you can do in order to replace the car you lost as a result of the accident.
I any situation like this is worth calling an attorney. What State/Country were you in?

I agree with MinD & Conor's advice to at least consult with an attorney. Just make sure you don't get sucked into doing something you don't want to do.

I was in a car accident 5 years ago. The car was totaled. The guy who hit us stole his ex wife's rental car and plowed into us head on. Smart. I only sprained my thumb, but since I was a massage therapist, my lawyer and dad pushed me into a lawsuit I didn't want to be in. FOUR years later we finally settled and I only received about $1,800 after all the fees were paid. It was NOT worth it.

Hope your doc gives you a clean bill of health!
btw, yes I completely agree with the other two here. It is important that you are not pressured or brow beaten into anything that you are not 100% comfortable with. I just think you should consult a lawyer because you mentioned the other person was arrested.

The vehicle was insured and so far my insurance company and the at-fault vehicle's insurance company have been cooperative. I used the PIP to go to the doctor today which will cover everything. The doctor said things look fine, just a lot of muscle strain. No concussion or anything serious. I think we're definitely going to talk to a lawyer to see if there's any kind of compensation we could receive since the driver should NOT have been on the road. This accident should not have happened.
